Terms of Service

1. Acceptance of Terms

By creating an account on SellStuff ("the Platform", "we", "us", "our"), you ("User", "you") unconditionally agree to be bound by these Terms of Service in their entirety. If you do not agree to every provision herein, you must immediately cease all use of the Platform. Your continued use constitutes irrevocable acceptance of these terms and any future amendments, which may be made at any time without prior notice.

2. No Liability for Transactions

SellStuff is a passive listing platform only. We do not participate in, facilitate, broker, guarantee, or endorse any transaction, sale, exchange, or transfer of goods between users. All transactions are conducted exclusively between buyers and sellers at their own risk and discretion.

WE EXPRESSLY DISCLAIM ALL LIABILITY for any loss, damage, injury, theft, fraud, misrepresentation, or dispute arising from or related to any transaction conducted through or facilitated by listings posted on the Platform. This includes but is not limited to: items not received, items received in a different condition than described, payment disputes, counterfeit goods, stolen property, and any physical harm arising from in-person exchanges.

You acknowledge that SellStuff is not a party to any agreement between users and has no obligation to mediate, arbitrate, or resolve any dispute between users under any circumstances.

3. No Liability for User-Provided Information

SellStuff does not verify, validate, screen, or authenticate any information provided by users, including but not limited to: names, email addresses, phone numbers, institutional affiliations, item descriptions, photographs, or pricing. All user-submitted content is published as-is without any representation or warranty as to its accuracy, completeness, or truthfulness.

YOU ASSUME ALL RISK associated with relying on information provided by other users. SellStuff shall not be liable for any harm resulting from inaccurate, misleading, fraudulent, or incomplete user-submitted information, including but not limited to financial loss, personal injury, or property damage.

4. Contact Between Users — Safety Disclaimer

The Platform may display contact information such as email addresses and phone numbers submitted voluntarily by users. SellStuff does not screen, background-check, or verify the identity of any user. You are solely responsible for exercising caution and good judgment when initiating contact with or meeting any other user.

All in-person meetings arranged through the Platform carry inherent risk. We strongly recommend meeting in public, well-lit locations, bringing a trusted companion, and never sharing sensitive personal information beyond what is necessary to complete a transaction.

SELLSTUFF EXPRESSLY DISCLAIMS ALL LIABILITY for any harm, injury, harassment, stalking, assault, theft, or other adverse outcome arising from contact or meetings between users, whether or not such contact was initiated through the Platform.

5. Prohibited Listings & User Conduct

Users are strictly prohibited from listing or attempting to sell: illegal items, controlled substances, weapons or firearms, stolen property, counterfeit goods, items that infringe on intellectual property rights, or any item whose sale is prohibited by applicable federal, state, or local law.

SellStuff reserves the right — but assumes no obligation — to remove any listing or suspend any account at its sole discretion, without notice, and without liability. Failure to remove a prohibited listing does not constitute endorsement of that listing or any associated transaction.

6. .edu Email Requirement & Account Eligibility

Access to the Platform requires a valid institutional email address ending in ".edu". By registering, you represent and warrant that you are a currently enrolled or affiliated student, faculty, or staff member of an accredited educational institution. SellStuff does not independently verify institutional affiliation. Any misrepresentation of eligibility constitutes a material breach of these Terms and may result in immediate account termination without refund.

7. Payment & Non-Refundable Fee

The one-time $9.00 USD platform access fee is non-refundable under all circumstances, including but not limited to: account suspension for Terms violations, voluntary account deletion, inability to complete a transaction, dissatisfaction with the Platform, or any other reason. Payment of this fee grants access to posting and contact features only and does not constitute any guarantee of successful transactions or outcomes.

8. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED SERVICE. SELLSTUFF DOES NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SELLSTUFF AND ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR SELLSTUFF WAS ADVISED OF THEIR POSSIBILITY. IN NO EVENT SHALL SELLSTUFF'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO ACCESS THE PLATFORM ($9.00 USD).

10. Indemnification

You agree to indemnify, defend, and hold harmless SellStuff and its owners, operators, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) any listing you post; (c) any transaction you enter into with another user; (d) your violation of these Terms; or (e) your violation of any applicable law or the rights of any third party.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively through binding arbitration on an individual basis. You waive any right to participate in class action litigation or class-wide arbitration.

12. Changes to Terms

SellStuff reserves the right to modify these Terms at any time without prior notice. Continued use of the Platform after any modification constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
